Specific Terms and Conditions of Sale for the Garden of Madness product

The combination of services offered to You under the Garden of Madness product as detailed herein is a travel within the meaning of the Directive (EU) 2015/2302, as transposed into the Belgian law of 21 November 2017 relating to the sale of travel packages, linked travel arrangements and travel services.

Therefore, You will benefit from all EU rights applying to packages.  WEAREONE.world bvba (“Tomorrowland”, “We”), with registered offices at Korte Vlierstraat 6 Box 211, 2000 Antwerp, Belgium will be responsible for the proper performance of the package as a whole.

Additionally, as required by law, we have protection in place to refund your payment. As transport is not included in the package, we do not ensure your repatriation in the event we should become insolvent.

ARTICLE 1 – GENERAL

These specific conditions of sale apply to the Garden of Madness product (“GOM product”) that is included in Your purchase of a Tomorrowland Magical Year Pass 2020 (the “Year Pass”) and consist of the following (for 2 people):

  • Event ticket: An entry ticket to one Garden of Madness event at Ushuaia Ibiza in summer 2020, at the buyer’s option yet on the basis of a pre-selection of dates made by Us (the “Event”).
  • Accommodation: One overnight hotel stay after the closing of the Event. Accommodation has a market value of EUR 250 per person.

You acknowledge that the General Conditions of Sale of the producer of the Event, Ushuaïa Ibiza, available below, also applies to Your purchase. You will be requested to accept these terms when making your purchase on the booking platform.

You acknowledge that the General Conditions of Sale of the hotel accommodation also apply to Your purchase. You will be requested to accepts these terms ultimately upon check-in.

ARTICLE 2 – PRICES AND PAYMENT

2.1 Prices are shown in EUR (€) for one Year Pass (incl. two persons in total). During the booking procedure and in the summary of the Year Pass, You will see a description of the characteristics of and essential information about the Garden of Madness product that is included in Your Purchase. Transport is not included.

Hotel accommodation includes daily breakfast and city taxes. If you have chosen for a double room, we cannot guarantee the type of room. You might end up in a room with two single beds or with one double bed.

A Year Pass is subject to availability and prices can change. When you make a search on our website for a Year Pass, our website will then check the live availability and price.

2.2 Unless otherwise agreed, You will pay the total cost of the Year Pass when making Your Purchase.

ARTICLE 3 – CANCELLATION CONDITIONS AND TRANSFERABILITY

3.1 You can cancel your purchase at any time before your departure in which case we will claim reasonable cancellation charges in accordance with the Travel Package Directive.

3.2 Should you purchase a separate ticket or multiple tickets for the GOM Event, then your purchase of a Year Pass will under no circumstances give rise to a cancellation or refund of such ticket(s).

ARTICLE 4 – RESPONSIBILITY FOR THE PERFORMANCE OF THE PACKAGE

Tomorrowland purchases certain elements included in the GOM Product (and, thus, the products and services under the Year Pass) from third parties and relies on a number of affiliated companies for its implementation. Notwithstanding, Tomorrowland bears final responsibility for the proper performance of the package as a whole.

You shall inform Us without undue delay (cf. contact data in Art. 10), taking into account the circumstances of the case, of any lack of conformity which You perceive during the performance of a travel service included in the package. We shall without delay give appropriate assistance when You are in difficulty during the performance of the package.

You are however responsible for obtaining all required travel documents (such as passports) and visas and for complying with all laws, regulations, orders, demands and travel requirements. It is Your responsibility to ensure that Your travel documents and visas will remain valid for the entirety of the travel, taking into account the possibility of flight disruptions, and that You carry these with You. To avoid putting your trip at risk, determine (this link can help) the travel documents and travel visa that you need.

ARTICLE 5 – INSURANCE

The Year Pass and the products/services included therein do not include insurance. You are strongly advised to check your insurances, such as, but not limited to, health and cancellation insurance.

ARTICLE 6 – HOTELS – RULES AND CONDITIONS 

Responsibility and Insurance

To the fullest extent permitted by applicable law, the hotel shall not be responsible for any damage to or loss of Your property. You accept Your responsibility to insure Your property.

Behavior

You must behave in accordance with accepted standards and the house rules of the hotel in which You are staying. Any serious or repeated violation of the hotel’s house rules entitles the hotel to put an end to Your stay without prior notification.

You are liable towards the hotel for any damage caused to persons, hotel property, fittings and equipment and those areas to which the general public has access.

You agree to inform the hotel of any change in the use of the rented premises and not to invite any person, and in particular any person whose behavior, reputation or respectability may in any way prejudice the hotel’s property or moral reputation. In the event of non-compliance with this obligation, the hotel has the right to refuse the concerned persons without compensation.

Security

You acknowledge the right of the hotel to take all emergency measures, which it deems necessary. These measures will be dictated by the management in a situation which puts the safety of any person or persons into danger. You do not have the right to claim any compensation from the hotel following the taking of these emergency measures.

The hotel reserves the right, in a situation where the behavior of one or more participants of the events puts the safety of people or the safety of the hotel in general into danger, to terminate the stay of those passengers in the hotel without advance notice and without any compensation to the client.

Check-in

In order to confirm a guest room, a security deposit and a valid government-issue photo ID will be required upon check-in. The security deposit can be used for any incidental charges (such as telephone and restaurant costs) that may be incurred during Your stay. Major credit cards are acceptable to establish the deposit. Your credit card will be charged immediately, and the amount will be blocked on Your credit card. Alternatively, the deposit can also be paid in cash. In case no incidental charges were incurred the hotel will release the remaining amount of the authorization if the deposit was paid via credit card. In case the security deposit was established in cash, the hotel will refund in cash (in euro currency).

Generally, without guaranteeing so, You can check in as from 15h00 and your room will be held until midnight. If You think You might arrive after midnight, please contact the hotel. Early check-in is at the discretion of the hotel and is based on the availability of Your room. 

Check-out

You can check out any time before the hotel's check-out time, which is generally, without guaranteeing so, around 11h00. If You need to check out an earlier day, the hotel will not be able to credit You for the unused portion of your stay.

Dispute Resolution

You agree, in case You have complaints, to directly contact the hotel management. You will attempt to solve the dispute amicably and refrain from communicating the content of the complaint by press or by any other known communication without having notified the hotel beforehand.

All complaints must be made in writing by registered post within 7 calendar days after the event. Any complaint received after this period will not be taken into consideration. In the case of disputes or legal procedures, only the courts of Antwerp (Belgium) shall have jurisdiction and the laws of Belgium shall be applied in all such disputes.

Smoking

Please take note that every hotel is fully non-smoking. In case You do smoke in the hotel, a fine for deep cleaning will be charged to You.

ARTICLE 10 – DISPUTES AND MEDIATION

In the event of a dispute, You on the one hand and WEAREONE.world bvba on the other hand shall first try to arrive at an amicable settlement between each other. The contact details to reach WEAREONE.world bvba are mentioned in Article 10 of these Terms and Conditions. If this attempt fails, then any of the parties involved can ask the Geschillencommissie Reizen vzw (i.e. the Belgian ‘Association Disputes Committee for the Travel Industry’) to initiate a mediation proceeding.

Ushuaïa Ibiza - Terms & Conditions 2020

- Right of admission is reserved.

- All assistants must take a valid ID.

- Dress code: No flip-flops, swimwear and / or football / basketball team jerseys are allowed.

- Ushuaïa Ibiza operates an over 18s policy. Anyone under the age of 18 will be refused entry.

- Early arrival is advisable to secure admission.

- Opening times are not fixed and may change on the day. The event finishes at 11PM.

- Ushuaïa Ibiza will not be held responsible for adverse weather conditions.

- Drink in moderation, it is your responsibility.

- Drug use is harmful to your health.

- Unauthorised recording is not allowed. GoPro attachments like selfie sticks, monopods and other professional photography equipment are not allowed at this event.

- It is strictly prohibited to bring beverages (both alcoholic and non-alcoholic) into the premises of Ushuaïa Ibiza Beach Hotel, either the club or the rooms.

- Lineups and set times may be subject to change.

- No re-entry allowed, once you exit the venue, you’ll have to pay again to access.

- Keep your ticket until the event has ended.

- Ticket refunds for a cancelled event can be requested during the 48 hours following the cancelled event.

- Assistants are responsible for their personal property at all times and should never leave their belongings unattended.

Both FIESTA HOTELS & RESORTS and LIPSTICK TRADERS shall process your personal data as joint controllers, for the purposes of taking images and recording video at the event to advertise it in any media, including web sites and social media. Basis for legitimacy: consent given when purchasing the ticket. Your personal data shall be kept as long as it’s bound by law or in the event you exercise your right to erasure.
